Townsend Ave. <br />Montrose, CO 81401 <br /> <br /> <br />Re: Bowie No. 1 Mine (Permit No. C-1981-038) <br /> Bond Release Application No. 7 (SL-7) <br /> <br /> <br />Dear Mr. Dyer: <br /> <br />The Division has issued a proposed decision to approve Bond Release Application No. 7 for the <br />Bowie No. 1 Mine. Enclosed is the Division's decision form and written findings. The proposed <br />decision will be published in the Delta County Independent, as soon as possible. The first day <br />following publication of the notice initiates a thirty-day public comment period. If there are no <br />requests for an adjudicatory hearing within the thirty days, the decision will become final. <br /> <br />This bond release application pertains to the ROM Area of the mine site, including the pond. The <br />SL-07 application included Phase III bond release on 10.72 acres (the entire ROM Area, including <br />the pond and the entrance road) and a Phase II bond rele ase on 0.51 acres (the pond within the <br />ROM Area). The Division is not proposing to release 0.34 acres for the entrance road, and the <br />resulting Phase III acreage is 10.38 acres (10.72 - 0.34). The road area was removed from <br />consideration for bond release because the reclamation plan for Bowie No. 1 Mine does not clearly <br />indicate that this shall be a permanent facility. As provided by Rule 3.03.2(6), should you object <br />to the Division's proposed decision, you may request an adjudicatory hearing. <br /> <br />If you have questions or are in need of additional information, please contact me. <br />
