This decision will become final at the close of the thirty (30) day public comment period, which commences the day following the initial publication in the Delta County Independent. A copy of the proposed decision and written findings is enclosed. This bond release application pertains to the ROM Area of the mine site, including the pond. The SL-07 application included Phase III bond release on 10.72 acres (the entire ROM Area, including the pond and the entrance road) and a Phase II bond rele ase on 0.51 acres (the pond within the ROM Area). The Division is not proposing to release 0.34 acres for the entrance road, and the resulting Phase III acreage is 10.38 acres (10.72 - 0.34). The road area was removed from consideration for bond release because the reclamation plan for Bowie No. 1 Mine does not clearly indicate that this shall be a permanent facility. Since this mine is a federal mine, our decision is subject to the concurrence of OSM, and the signature of an authorized OSM representative is required for release of the bond. Therefore, the Division respectfully requests that OSM notify the Division of concurrence or nonconcurrence prior to the end of the public comment period, in accordance with the agreement dated June 30, 1997, Procedures for Cooperating State and Federal Agencies to Provide Mutual Concurrence on the Release of Performance Bonds from Federal Lands Coal Mining Operations.
