PART <br /> Page 9 of 67 <br /> Permit No.: COG500000 <br /> Modifications include but are not limited to: adding or removing discharge outfalls, introducing new or additional chemicals to <br /> the treatment process or effluent, modifying treatment in a manner that would result in a new or altered discharge in terms of <br /> location or effluent quality, changing permit coverage from one that authorizes process water discharges(or process water <br /> and stormwater discharges),to one that authorizes stormwater discharges only because the process water discharge has been <br /> terminated,etc. Note that modifications may be subject to a fee,consistent with Part II of the permit. <br /> a. The permittee must submit a complete and accurate Modification Form,signed by the permittee,to the Division at the <br /> address listed in Part I.A.4, at least 60 days prior to implementing any requested modifications that result in a <br /> discharge to state waters. <br /> b. The permittee is not authorized to discharge under the modified conditions until the modified certification is issued <br /> and effective. <br /> 7. Permit Termination Procedures <br /> To terminate permit coverage,the permittee must submit a complete and accurate Notice of Termination form,signed by the <br /> permittee,to the Division at the address listed in Part I.A.4. The permittee's authorization to discharge under this permit <br /> terminates as notified by the Division. <br /> A Notice of Termination request that does not meet one or more of the conditions identified below is not valid.The permittee is <br /> responsible for complying with the terms of this permit until notified by the Division that the authorization is terminated. <br /> Conditions for a Notice of Termination request include: <br /> a. Termination Criteria for facilities with Division of Reclamation, Mining and Safety(DRMS)financial and performance <br /> warranties <br /> The Division may approve a Notice of Termination request when the following criteria are met for the entire sand and <br /> gravel facility: <br /> i. all permitted process water discharges authorized by this permit(as applicable to the facility), have ceased;and <br /> ii. all permitted stormwater discharges authorized by this permit have ceased because the industrial activity <br /> (including soil disturbing activities) has ceased, and no significant materials or industrial pollutants remain exposed <br /> to stormwater(i.e.,all raw materials, intermediate products, byproducts,finished products and waste products <br /> have been removed or are not exposed to stormwater); and <br /> iii. the DRMS has released the permittee from further responsibility for the facility, and the permittee provides <br /> documentation with the Notice of Termination request that DRMS approved the applicable financial and <br /> performance warranty release. <br /> b. Termination Criteria for facilities without DRMS financial and performance warranties <br /> The Division may approve a Notice of Termination request when the following criteria are met for the entire sand and <br /> gravel facility: <br /> i. all permitted process water discharges authorized by this permit(as applicable to the facility), have ceased;and <br /> ii. all permitted stormwater discharges authorized by this permit have ceased because the industrial activity <br /> (including soil disturbing activities) has ceased, and no significant materials or industrial pollutants remain exposed <br /> to stormwater(i.e., all raw materials, intermediate products, byproducts,finished products and waste products <br /> have been removed or are not exposed to stormwater); and <br /> iii. the site has attained final stabilization, with little evidence of soil erosion or other runoff problem, as follows: <br /> a) a uniform, perennial vegetative cover has been established with a plant density of at least 70 percent of <br /> pre-disturbance levels, or equivalent permanent, physical erosion reduction methods have been <br /> employed; <br /> b) all alternatives to vegetation must be permanent, must stabilize all disturbed areas, and all stabilization <br /> control measures must be selected, installed, and implemented following good engineering, hydrologic, <br /> and oollution control practices adequate to prevent pollution or degradation of State waters; <br />
