DocuSign EnvOope ID!46DB6AOD-4BO7-4278-9OB7-73D382DBAFOO <br /> FIRST AMEN DMENT "TO CONSUMABLE WATER LEASE AGREEMENT <br /> THIS FIRST AMENDMENT TO CONSUMABLE WATER LEASE <br /> AGREEMENT is entered into this 14th day of lanuarY 2020, between the City of <br /> Westminster("Westminster"), lessor, and Aggregate Industries-WCR, Inc., a Colorado <br /> corporation ("Al")�, lessee, (collectively, the"Parties"). <br /> WHEREAS, Westminster and AI are parties to an Agreement dated October 24,2000, <br /> (the"Storage Agreement"),as amended on February 10, 20 10,whereby Al is mining gravel <br /> deposits from certain lands located near Watteriberg,Colorado and, upon completion of mining, <br /> is constructing a water storage reservoir for Westminster on said lands; <br /> WHEREAS,, in connection with the Storage Agreement, the Parties entered into a <br /> Consumable Water Lease Agreement dated March 4, 201 O,concerning Westminster's delivery <br /> of certain fully consumable water to Al, (the"Consumable Water Lease"); <br /> WHEREAS, pursuant to the terms,of the Consumable Water Lease, Westminster leased <br /> Lip to 519 acre feet (AF) of fully consumable water to Al; <br /> WHEREAS, the current Consumable Water Lease will expire Linder its own terms no <br /> later than December 31, 20 19; <br /> WHEREAS, in accordance with paragraph 3.12 of the Consumable Water Lease, the <br /> Parties may annend said lease by mutual written agreement; and, <br /> WHEREAS,the Parties desire to extend the term of the Consumable Water Lease and <br /> amend it consistent with this First Amendment to Consumable Water Lease Agreement("First <br /> Amendment"). <br /> NOW THEREFORE, the Parties agree as follows: <br /> 1. Paragraph 2 of the Consumable Water Lease is amended by deleting the entire <br /> paragraph and replacing it with the following: <br /> Westminster will lease to Alfor the terra of this Agreement ul) to 250 acre- <br /> feet (Al,) annually of Clonsuniable Water from Wesiminster's municipal water <br /> SUIPPly system subject to lhefiirther terries and conoitions of this Agreenient. <br /> 2. Paragraph 2.1 of the Consumable Water Lease is amended by,deleting the entire <br /> paragraph and replacing it with the following: <br /> 2.1 Term of Lease.
