EXHIBIT D <br /> RECLAMATION PLAN <br /> COUNTY: Lincoln <br /> OPERATOR: Castle Rock Construction Co. of Colorado, LLC <br /> 1. 6-10" of topsoil is currently present on the site and will be stripped and <br /> stockpiled. <br /> 2. The final slopes will be a maximum of 4:1 or flatter. Final slopes, both new and <br /> existing that are disturbed, will be reclaimed, and the farmer will then plant oats <br /> in this area. It is Christopher Nestor's intent to farm this land in oats for a <br /> minimum of 3 years to see if he can raise a crop. <br /> 3. No blanket or mulch tackifier is anticipated to be necessary. <br /> 4. The final use of the pit is farmland. <br /> 5. No trees or shrubs will be removed from the farmland but roots, stumps and other <br /> deciduous material will have to be removed from the ground. <br /> 6. No streams, roads or building will be affected after reclamation. <br /> 7. Temporary berms will be removed as reclamation progresses. <br /> 8. Salvaging and placing all existing topsoil will create a good seed bed. <br /> 9. Seeding will perform each spring for the next 3 years in oats. James Christopher <br /> Nestor intends to farm this area. The 2 intents of this mine are to remove some <br /> stumps, roots and other debris in the land and make it more conducive to farming. <br /> 10. The seeding will be done once the reclamation is complete. At that time, we will <br /> seed the area in oats, as the farmer wants. This will be done to try to establish <br /> some growth to stabilize the land and prevent runoff. This will be a temporary <br /> measure until spring when the farmer replants his oats. <br /> 11. Prior to the seeding process, the reclaimed soil will be tested to determine the <br /> need for fertilizer. The test results will be discussed with the Farmer for <br /> recommendations and his wishes. <br /> 12. The following seeding plan and all the conditions required in that plan will be <br /> utilized in the reclamation of the pit as necessary. <br />
