Western Slope Flagstone Quarry No. 2, Permit No. M-1996-076,Acreage Reduction(AR-1), <br /> Approval <br /> Dear Mr. Fontanari: <br /> On November 18, 2020 the Colorado Division of Reclamation, Mining, and Safety(Division) received <br /> your Acreage Reduction Request (AR-1),which was considered filed on November 20, 2020. <br /> AR-1 was submitted in response to Board Order MV-2020-023, which had an effective date on October <br /> 27, 2020.Corrective Action#1 of MV-2020-023 required the Operator to <br /> "Within thirty days of the effective date of this Order,the Operator shall submit a written plan <br /> and gain approval to either: a) remove all water distribution lines, risers and grade ditches used <br /> to convey water associated with the middle field within the permit boundary; or b) remove the <br /> irrigated portion of the middle field from the mine permit boundary;" <br /> The Operator elected for option "B",to request release of the 3.17 acres known as the middle field.The <br /> decision due date was extended several times to address adequacies with the revised Mining and <br /> Reclamation Plan maps. On April 1, 2021 the Division received said maps which accurately depict the <br /> proposed permit boundary and meet the requirements of the Act and Rules.A site inspection was not <br /> conducted.On April 2, 2021,the Division approved your request for release of a portion of the permit <br /> area from further reclamation responsibility. <br /> The permit was reduced from 141.92 acres to 138.75 acres. <br /> Please note you are still liable for filing annual reports and fees and maintaining the financial warranty in <br /> good standing. <br /> If you require additional information,or have questions or concerns, please feel free to contact me. <br /> Amy Yeldell at the Division of Reclamation, Mining and Safety, 1313 Sherman St., Room 215, Denver, CO <br /> 80203.
