3. If Operator fails to comply with any of the corrective actions of this Order <br /> within thirty days of the effective date of this Order, the Division is <br /> directed to schedule the matter before the Board for permit revocation at <br /> the Board's next available meeting. <br /> The Board imposes a CIVIL PENALTY for 79 days of violation at $1000 per <br /> day for a total civil penalty of$79,000.00, with all but$10,000 of the penalty <br /> suspended if Operator complies with the corrective actions. The $10,000.00 in <br /> unsuspended civil penalties is due and payable within 30 days of the effective date <br /> of this Order. Where corrective actions are not completed within the required <br /> period, the unsuspended portion of the civil penalties, $69,000.00, shall be <br /> immediately due and payable. Failure to submit any due and unpaid civil penalties <br /> shall result in immediate submittal of such penalties to collections. <br /> DONE AND ORDERED this day of 2020. <br /> FOR THE COLORADO MINED LAND <br /> RECLAMATION BOARD <br /> Nell Ze m-Morris, Chair <br /> NOTICE OF APPEAL. (2020) and the Colorado <br /> Rules of Civil Procedure.
