I. PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br /> CAM-Colorado, LLC applied for full bond release and termination of jurisdiction under the <br /> Colorado Surface Coal Mining and Reclamation Act following reclamation of the Fruita Loadout. <br /> The mine is located in Mesa County,Township 1 North, Range 3 West <br /> Section 2: Portions of the SWA,W/2SW/4SE/4 <br /> Section 3: Portions of the SEA <br /> Section 10: Portions of the N/2NE/4 <br /> Section 11: Portions of the N/2NW/4,W/2NW/4NE/4. <br /> An application for Phase I, H and III bond release and termination of jurisdiction was received by <br /> the Division on November 17, 2020. The application was deemed complete on November 20, <br /> 2020, after the Division received proof of publication of the applicant's public notice. CAM- <br /> Colorado,LLC published notice of the bond release application in The Daily Sentinel once weekly <br /> for four consecutive weeks,beginning October 15,2020. CAM-Colorado,LLC also notified land <br /> owners within and adjacent to the mine permit area, and other interested parties of the application <br /> for bond release, as required by Rule 3.03.2(1). <br /> No comments, written objections, or requests for an informal conference regarding the bond <br /> release application were received by the Division. <br /> The Division scheduled and conducted a bond release inspection on March 31, 2021. The site <br /> inspection was conducted in accordance with Rule 3.03.2(2). The inspection was held later than <br /> 30 days past the completeness determination of the application in order to avoid winter weather <br /> conditions. Clayton Wein of the Division was accompanied by James Stover Q. E. Stover and <br /> Associates)representing CAM-Colorado,LLC. <br /> II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br /> PHASE I <br /> Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when the <br /> permittee successfully completes backfilling, regrading, and drainage control in accordance with the <br /> approved reclamation plan." With regard to Phase I bond release,the approved reclamation plan for the <br /> Fruita Loadout,starting on page 2.05-29 of the C-2010-088 Permit Application Package(PAP), addresses <br /> where backfilling and regarding activities will take place at the loadout. Areas in the eastern,middle and <br /> western portions of the permit area were planned to be disturbed. After the demolition of structures,work <br /> to return the land to approximate original contour would begin. Ballast,sub-ballast and cover fill material <br /> would be used to create the approved contours. <br /> Permit Number C-2010-088 Page 3 of 7 <br />
