EXHIBIT D — Mining Plan <br /> The following is the general outline of Phillips County's Biesemeier pit proposed mining <br /> operation. <br /> A) Mining will utilize the following operations: <br /> a. Use of dozer to remove and stockpile existing top soil <br /> b. Utilize dozer to remove and stockpile overburden <br /> c. Utilize dozer to push up gravel <br /> d. Utilize a front-end loader or track hoe to load material onto trucks <br /> B) The site will be mined to approximately 6' in depth. Mining will be done on an approximate <br /> 3:1 slope down to the bottom of the pit area. There is no topsoil in the actual dry creek bed <br /> itself. Topsoil outside the creek bed ranges from V-5" in depth. <br /> C) Material will be mined from the creek bed beginning on the east edge of the permitted <br /> area. Our intent is to mine only a few acres at a time. Excavation will proceed to the west as <br /> gravel is needed for local road operations and as long as the supply remains available. <br /> D) Any topsoil in the area to be disturbed by mining or stockpiling will be stripped and <br /> stockpiled separately for use in reclaiming. The stockpile will be seeded with brome grass to <br /> prevent erosion. <br /> E) The sand and gravel, at an approximate starting depth of four to five feet, will be bulldozed <br /> from the creek bed on to the bank into a stockpile where it can be loaded on to trucks and <br /> hauled on to the local roads. No other commodities will be mined from this site and no <br /> explosives will be used in the mining process. The material mined will be used primarily as <br /> road building material. <br /> F) Any stockpiling that occurs will parallel the creek bed and be out of the actual flow area. <br /> G) The are not anticipated water diversions or impoundments. There is no surface water at the <br /> site. No water will be used in conjunction with the operation. When rainfall occurs, the pit <br /> may be unworkable for a brief time. Since the use of the pit is intermittent, we will be able <br /> to work around those occurrences. Mining will not go into the groundwater site. <br /> H) No on-site processing is anticipated. <br />
