<br /> <br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve <br />Bond Release Application No. 3 (SL-3) for the Elk Creek Mine, Permit No. C-1981-022. SL-3 <br />releases 50.44 acres of GVB pads and roads from liability for topsoil redistribution and <br />establishment of vegetation. The underground operation is operated by Oxbow Mining, LLC under <br />the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The bond release <br />application was submitted by Oxbow Mining, LLC on August 18, 2020. SL-3 seeks Phase II bond <br />release on approximately 50.44 acres which were reclaimed between 2015 and 2017. The affected <br />area is located in Delta, Gunnison County, approximately 0 miles North of Somerset, Colorado. <br /> <br />Copies of the proposed decision are available for review at <br />https://dnrweblink.state.co.us/drms/search.aspx by searching C1981022 in the “Permit No” field. <br />A user guide is available to help first time users of the imaged document system and can be viewed <br />at https://drive.google.com/file/d/1l8OUdf_Mpjo3kxIHkP5hMH-w7MeBtxX7/view.. <br /> <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision.
