<br /> <br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve <br />Bond Release Application No. 2 (SL-2) for the Elk Creek Mine, Permit No. C-1981-022. SL-2 <br />releases approximately 138.74 acres of reclaimed surface facilities, coal waste piles, mine <br />ventilation boreholes, drill pads and associated roads, as well as facilities that have been <br />repurposed for industrial or commercial uses. Reclamation work was completed in the areas <br />requested for release between 1996 and 2017. SL-2 releases 60% of the bond applicable to 66.05 <br />acres released from Phase I reclamation liability (West Valley Fill, II West Valley Fill, and a <br />portion of the Gob Vent Boreholes and associated pads and roads), 85% of the bond applicable to <br />70.36 acres released from Phase I & II reclamation liability (Bear Creek B-Seam Portal & Fansite <br />(US Steel), Lower Hubbard Creek facilities area, Hubbard Creek Fan #1 Site, and a portion of the <br />Gob Vent Boreholes and associated pads and roads), and 100% of the bond applicable to 2.33 <br />acres released from Phase I, II & III reclamation liability (Bear Creek Fansite (leased to Vessels). <br />The underground operation is operated by Oxbow Mining, LLC under the provisions of the Colorado <br />Surface Coal Mining Reclamation Act of 1979. The bond release application was submitted by <br />Oxbow Mining, LLC on September 16, 2019.
