LYOANSINEGADDIS
DIVISION OF RECLAMATION,MINING,AND SAFETY
Page 2
March 24,2021
a. Signed structure agreements from Xcel Energy, Granby Sanitation, CDOT, and
MPEI;
b. Emails and correspondence from our office to Union Pacific-we have addressed
the issue of the Union Pacific structures below in this letter.
(5) A revised Exhibit C-2, which shows the various structure owners. The previous exhibit
mistakenly showed the Raw Water Pump Station and the Water Treatment Plant owned
by the Town of Granby. That is incorrect, as both are owned by the applicant and have
not been dedicated. No dedication is contemplated at this time. Accordingly, when I
contacted the Town of Granby, their counsel informed me that such improvements had
not been dedicated.
With respect to the unanswered structure agreement request sent to Union Pacific,we are hoping
to proceed with the application, as the activity contemplated by Sun is merely excavation of
surface construction materials, without any more intrusive methods. There is no blasting
contemplated, and all such activity is taking place further than 400 feet from any structure,
including the Union Pacific lines. There will be transportation of such construction materials
around the permit area for use in Sun's development of the Property, and such transport may
occur within 200 feet of the Union Pacific lines, but Sun intends to use all of the construction
materials within the property itself, and not to be moved to other properties or third-parties. On
the following page,we have included an acknowledgement to this effect from the applicant.
Please contact me via email (sstewart®lyonsgaddis.com) or phone (720-984-4785) with any
questions regarding this application or any additional information needed.
Sincerely,
By:
Sean M.Stewart
SMS
Enclosure
