4. Jubilee Venture, Inc. has abandoned its operation prior to completing reclamation. <br /> Abandoning any operation prior to complying with the required reclamation is a <br /> prohibited act under 43 CFR 43 CFR 3809.605 (h). <br /> 5. Failure to maintain structures, equipment, and other facilities in a safe and orderly <br /> manner as required in the performance standards of the approved Plan of Operations. <br /> Jubilee Venture, Inc. was issued a Noncompliance Order on July 22, 2020, with <br /> instruction on how to correct the noncompliance. Jubilee Venture, Inc. failed to follow <br /> the Noncompliance Order as evidenced by the inspection on December 22, 2020, and a <br /> notification that the BLM intended to issue a Suspension Order was issued to Jubilee <br /> Venture, Inc. on January 14, 2021. The notification that the BLM intended to issue a <br /> Suspension Order was returned to the BLM January 18, 2021 marked "Return to Sender; <br /> No Mail Receptacle; Unable to Forward". <br /> The inspection of December 22, 2020 showed that the conditions of the Noncompliance <br /> Order were not met. Jubilee Venture did not control noxious weeds, begin reclamation, <br /> or maintain their structures in a safe and orderly manner by either reclaiming the sump <br /> or making it compliant with federal regulations. Additionally, Jubilee Venture, Inc. did <br /> not provide a valid mailing address and phone number. <br /> Therefore, in accordance with the authority at 43 CFR 3809.601(b), Jubilee Venture, Inc. is <br /> ordered to immediately cease surface disturbing activity until it complies with the July 22, 2020 <br /> Noncompliance Order and is told by the BLM that operations may proceed. <br /> Under the terms of this suspension, effective upon receipt of this letter you must: <br /> 1. End all surface disturbing activities. <br /> 2. Provide a valid mailing address and phone number. <br /> 3. Control the noxious weeds as per the approved Plan of Operations. <br /> 4. Reclaim the sump or secure the sump so that it complies with federal regulations. <br /> 5. Begin reclamation of the site. <br /> If you do not comply with this order, the Department of the Interior may request the United <br /> States Attorney to institute a civil action in United States District Court for an injunction or <br /> order to enforce this order to prevent you from conducting operations on the public lands in <br /> violation of this subpart, and collect damages resulting from unlawful acts (see 43 CFR <br /> 3809.604). Additionally, if you fail to adhere to the terms of this order, you may face arrest and <br /> trial under Section 303(a) of the Federal Land Policy Management Act(43 U.S.C. 1733(a)). If <br /> convicted,you will be subject to a fine of not more than $100,000 or the alternate fine provided <br /> for in the applicable provisionsof 18 U.S.C. 3571, or imprisonment not to exceed 12 months, or <br />
