EXHIBIT L— PERMANENT MAN-MADE STRUCTURES <br /> 1. Refer to Exhibit A Map, Exhibit B, and Exhibit E Maps. <br /> 2. Inventory: Most structures belong to the Landowner and covered under the gravel property lease <br /> (Exhibit G)The only significant, permanent, manmade structures within 200 feet of the Site are: <br /> • irrigation ditches: <br /> o various laterals in the field in/around the Yard and Access Road belonging to the Landowner,and <br /> o irrigation ditch on the South side of CR-15, including existing permanent 24-inch x 30-foot culvert for farm <br /> field access(to be used for access road for 110-permit)belonging to the Landowner. <br /> • fencing(3-or 4-strand barbed-wire with wire gates and reinforced corners): <br /> o along CR-15 south edge of the right of way(belonging to the Landowner),and <br /> 0 other temporary/permanent fences in the field around the Yard and Access road(belonging to the <br /> Landowner <br /> road(CR-15, a county-owned two-lane,20 to 30-foot wide,gravel roadway),and <br /> • underground utility line(SLVREC)as shown on maps(Exhibit E),crossing the access road and the Yard. <br /> 3. Observations and Analysis:All irrigation laterals are to be replaced by a pivot irrigation system after <br /> reclamation and are not considered significant by the Landowner.The existing farm field access, <br /> including the culvert over the irrigation ditch will be restored as necessary at the end of the mining <br /> and reclamation, and is included in the lease agreement between the Landlord and O'Rourke.The <br /> Rio Grande County Road and Bridge Department (RGCR&BD) Supervisor concurs with the Preparer's <br /> professional opinion that construction, use, and removal of the Access Road does not have <br /> significant potential for damage to the County Road. Further,the county road and the SLVREC <br /> underground powerline are included in the County CUP Permit 2020-20 which requires <br /> indemnification of any damage to them by activities on the Yard or access road, and includes <br /> procedures for maintenance and repair, including cost-sharing. <br /> The irrigation ditch near CR-15 is owned by the landowners,and indemnity against damage is <br /> included in the lease agreement between them and O'Rourke. As the culvert and apron to be used <br /> by the Access Road is already in place and will be a permanent feature,this is also included in the <br /> lease agreement. In the opinion of the Preparer,the construction, use, and removal of the Access <br /> Road does not have significant potential for damage to the irrigation ditch and culvert, based on site <br /> inspection of 17 February 2021. <br /> Requests for letter and/or structure agreement have been made to SLVREC(letter received and <br /> attached at Figure L-1) and RGCR&BD (copy of request letter and agreement and screenshot of <br /> email to which they were attached at Figure L-2).
