DRMS finds the <br /> applicable success standards have been met. <br /> V. PROPOSED DECISION <br /> Based on the above observations, the Division proposes to approve Moffat County Mining LLC's <br /> request for a partial Phase I, II and III bond release. This proposed decision will release the applicant <br /> from Phase I, II and III reclamation liability for those SL4 bond release parcels totaling 323.70 acres. <br /> The Division holds a performance bond of$4,691,000.00 for the Williams Fork Mine. The current required <br /> surety amount based on the approval of SL5 is$3,808,607.52. The total applicable bond for the 323.70 <br /> acres of Phase I,II and III reclamation is $2,657,357.03. However,based on DRMS' estimate it would <br /> cost the Division$1,708,602.00 to complete reclamation at the site in accordance with the reclamation plan. <br /> The Division cannot release the entire applicable bond associated with the SL4 acres because it would <br /> reduce the required surety amount below the amount the Division would need to complete reclamation. In <br /> order to hold adequate bond for the reclamation liability calculated for Mid Term Review 8,the Division <br /> proposes to release $2,100,005.52 with SL4 and retain the required$1,708,602.00 to complete reclamation. <br /> Reclamation work remaining to be done at the site includes pond reclamation around the remaining affected <br /> land;backfilling,grading,topsoiling,and seeding at the 5A portal and refuse pile, removing waste material, <br /> and sealing all required wells and boreholes. Also the reclamation completed at the No. 9 portal has not been <br /> released. Phase II and III liability remain for the SL5 area as well. <br /> Any person with a valid legal interest which might be adversely affected by this proposed decision may <br /> request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br /> 3.03.2(6). Public notice of this proposed decision will be published twice in the Steamboat Pilot as <br /> soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty <br /> days of the first publication in the Steamboat Pilot.
