The demolition of structures, and sealing and backfilling of the portals and vent shaft took place <br /> well before the submission of the SL-4 application,but was documented in the reports of <br /> inspections carried out at the time(see inspection reports dated August 12, September 10, <br /> October 16 and November 13, 2003) <br /> Summary and Conclusions <br /> Based upon a review of the mine permit,the applicant's bond release application, and site inspections, <br /> the Division finds that Oxbow Mining,LLC has completed backfilling, grading and drainage <br /> reestablishment at the Elk Creek Mine in accordance with the approved reclamation plan. <br /> PHASE II <br /> Group 1 (Bear Creek B-Seam Portal&Fansite(US Steel), Lower Hubbard Creek facilities area, <br /> Hubbard Creek Fan 91 Site) <br /> These sites were released from Phase H reclamation liability with SL-2. <br /> Group 2 (Sanborn Creek Mine Portals area, Sanbom Creek Mine Fan site) <br /> These sites have been approved for a post-mining land use of"Industrial/Commercial", and will <br /> be utilized by the North Fork Energy, LLC methane project. There is no revegetation standard. <br /> Erosion is minimized and controlled by in-place best management practices. During the SL-4 <br /> inspection it was noted that no erosional features or bare areas were observed. <br /> Summary and Conclusions <br /> Based upon a review of the mine permit,the applicant's bond release application, and site inspections, <br /> the Division finds that Oxbow Mining,LLC has replaced topsoil in accordance with the approved <br /> reclamation plan. Oxbow Mining,LLC has established vegetation which supports the approved post <br /> mine land use and meets the approved success standard for vegetative cover. The Division finds that the <br /> reclaimed area subject to this bond release is not contributing suspended solids to streamflow or runoff <br /> outside the permit area in excess of premising levels or in excess of adjacent nonmined areas. <br /> PHASE III <br /> Group I (Bear Creek B-Seam Portal&Fansite (US Steel),Lower Hubbard Creek facilities area, <br /> Hubbard Creek Fan 91 Site) <br /> During the SL-4 inspection the establishment of vegetation was inspected, and the land's <br /> capacity to support the post-mining land use was evaluated. Vegetative cover and species <br /> composition were visually evaluated to ensure that the reclaimed area would not excessively <br /> contribute suspended solids to streamflow outside of the permit area and that predominant <br /> species would support the post-mining land use. No noxious or invasive species were noted <br /> during the inspection. <br /> C-1981-022,SL-4 Page 7 of 10 <br />
