Where the nature of certain tasks and the circumstances surrounding their performance <br />did not allow for individual time entries, aggregate time entries were used. <br />22. Attached hereto as Exhibit D is a summary of fees incurred by project category, as <br />more fully discussed below. <br />Reimbursement of Expenses <br />23. Pursuant to § 330(a)(1)(A) of the Bankruptcy Code, the Court may award a <br />professional "reimbursement for actual, necessary expenses." 11 U.S.C. § 330(a)(1)(A). <br />Accordingly, Foley seeks reimbursement of the actual, necessary expenses that it incurred during <br />the period covered by this Application. Charges for travel, overnight delivery, postage, and other <br />out-of-pocket disbursements are based on actual amounts paid by Foley for those services. Exhibit <br />C also contains detailed description of expenses that Foley incurred from August 3, 2020 through <br />and including January 31, 2021. Attached as Exhibit E is an expense summary by category. <br />NARRATIVE SUMMARY OF SERVICES PERFORMED' <br />A. Asset Analysis and Recovery (85.1 hours, $53,895.80 in fees) <br />24. Foley prepared diligence lists and reviewed documents related to the Debtors' <br />business, assets and causes of action. Foley also reviewed and analyzed various causes of action <br />against the Lenders, insiders and other parties. In addition, Foley negotiated and documented two <br />settlements with the Lenders that resolved various causes of action. <br />25. This category also contains entries for Foley's review of certain claims against <br />directors and officers as well as certain director and officer liability insurance issues. <br />B. Asset Disposition (106.3 hours, $64,455.50 in fees) <br />3 The aggregate amount of fees included for the various categories exceeds the amount requested for this Application <br />period by $13,214.56, the amount by which Foley has agreed to reduce its fees pursuant to the Committee's Fee Cap. <br />4812-4378-2110.1 <br />
