The Court must receive your response on or before the Response Deadline. You must <br />also send a copy of your response either by the Court's ECF System or by first-class mail to Amelia <br />M. Adams and Gregory D. Pavey, Stoll Keenon Ogden PLLC, 300 West Vine Street, Suite 2100, <br />Lexington, KY 40507. <br />Any responses or objections to the relief requested in the Application shall: (a) be in <br />writing; (b) conform to the Federal Rules of Bankruptcy Procedure, the Local Bankruptcy Rules <br />for the Southern District of Ohio, General Order 30-3 from the United States Bankruptcy Court <br />for the Southern District of Ohio, dated December 4, 2019 ("General Order"), and the Case <br />Management Order [Docket No. 89 "Case Management Order"] in these bankruptcy cases; (c) be <br />filed electronically with the Court on the docket of In re Hopedale Mining LLC, Case No. <br />1:20-bk-12043 (GRH), by registered users of the Court's electronic filing system and in <br />accordance with the General Order (which is available on the Court's website at <br />http://www.ohsb.uscourts.gov); and (d) be served so as to be actually received not later than <br />the Response Deadline stated above on (i) the entities on the "Master Service List" (as defined <br />in the Case Management Order), which is available on the Debtors' case website at <br />https:Hdm.epigl Lcom/Hopedale and (ii) any person or entity with a particularized interest in the <br />subject matter of the Application. <br />If you or your attorney do not take these steps, the Court may decide that you do not oppose <br />the relief sought in the Application and may enter an order granting that relief. <br />Pursuant to paragraph 26 of the Findings of Fact, Conclusions of Law, and Order (I) <br />Approving the Disclosure Statement on a Final Basis, and (II) Confirming the Joint Plan of <br />Orderly Liquidation [Docket No. 580], if no responses or objections are timely filed and served in <br />accordance with the Case Management Order with respect to the Application, then after the <br />Response Deadline has passed, Caterpillar's counsel may file a certification that no objection has <br />been filed or served on them, and may request that the Court grant the relief and enter an order <br />without a hearing. <br />Dated: March 2, 2021 Respectfully submitted, <br />/s/ Amelia M.
