Each <br />of the Proofs of Claim and all documents attached thereto are incorporated by reference as though <br />fully set forth herein. <br />13. On January 15, 2021, the Court entered the Findings ofFact, Conclusions ofLaw, <br />and Order (I) Approving the Disclosure Statement on a Final Basis, and (II) Confirming the Joint <br />Plan of Orderly Liquidation [Docket No. 580 "Confirmation Order")] and thereby confirmed the <br />Plan that was attached to the Confirmation Order as Exhibit A and had previously been filed as <br />Docket No. 529 ("Plan"). The Effective Date of the Plan was February 1, 2021 ("Effective Date") <br />See Notice of (I) Entry of Order Confirming Plan of Orderly Liquidation, (B) Effective Date of <br />Plan, and (C) Deadline for Filing Certain Claims [Docket No. 588 ("Confirmation Notice")]. <br />14. Upon information and belief, based upon discussions with Caterpillar's business <br />representatives, the Debtors used the Leased Equipment in their business operations between the <br />Petition Date and the Rejection Date, and that use benefitted and preserved the Debtors' estates. <br />However, the Debtors did not make any monthly rent payments to Caterpillar that came due <br />between the Petition Date and the Rejection Date. The following rent payments remain unpaid, <br />and they all constitute actual, necessary costs and expenses of preserving the Debtors' estates under <br />11 U.S.C. § 503(b)(1)(A): <br />E <br />
