The following adequacy review items will need to be <br /> addressed prior to the Division's approval of the application: <br /> General Questions <br /> 1. The Operator has selected the option to waive their right to a decision within 30 days. The <br /> Operator needs to understand that on future inspections an increase to the Financial Warranty <br /> may be warranted based on the current conditions of the site. <br /> 2. There is currently an amendment in the system to increase the permit boundary. On the <br /> application, the Operator is listed as C & H Solutions. The Operator will need to resubmit the <br /> application page of the amendment changing the name to C& H Aggregates, LLC and provide a <br /> statement to the Division as to why there is a discrepancy between the two names. <br /> Performance and Financial Warranty <br /> 1. An Affidavit of Authority is required. This should be filled out by Cliff E. Simpson and notarized. <br /> 2. The Original Financial Warranty needs to be mailed to the Division. <br /> 3. Page 5 of the Financial Warranty needs to be signed by Cliff E. Simpson. Since he didn't <br /> execute, the notary of his signature (page 6) is invalid. Upon his execution, a new notary page <br /> needs to be submitted. <br /> This concludes the Division's adequacy review of amendment application. The adequacy issue listed <br /> above must be addressed to the Division's satisfaction prior to the decision date, please submit your <br /> adequacy response no later than three days prior to the decision date.
