Any discharge to the waters <br /> of the State from a point source other than specifically authorized by this permit is prohibited. <br /> UST1A is an in-stream permitted feature located upstream from the facility discharge to collect continuous ambient <br /> temperature data at 38.90500' North latitude, 107.443056 West longitude. <br /> UST2A is an in-stream permitted feature located upstream from the facility discharge to collect continuous ambient <br /> temperature data at 38.88139' North latitude, 107.45102' West longitude. <br /> B. PERMIT COMPLIANCE <br /> In accordance with the Water Quality Control Commission Regulations for Effluent Limitations, Section 62.4, and the <br /> Colorado Discharge Permit System Regulations, Section 61.8(2), 5 C.C.R. 1002-61, and the federal Effluent Limitation <br /> Guideline for the Coal Mining Point Source (40 CFR 434), the permitted discharge shall not contain effluent parameter <br /> concentrations which exceed the limitations specified below or exceed the specified flow limitation. All discharges <br /> authorized under this permit shall comply with all the terms and conditions required by this permit. Violation of the <br /> terms and conditions specified in this permit may be subject to civil and criminal liability pursuant to sections 25-8-601 <br /> through 612, C.R.S.. Failure to take any required corrective actions, as detailed in the CORRECTIVE ACTIONS section, <br /> constitutes an independent, additional violation of this permit and may be subject to civil and criminal liability. <br /> Facilities Operation and Maintenance <br /> The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control <br /> (and related appurtenances) which are installed or used by the permittee as necessary to achieve compliance with <br /> the conditions of this permit. Proper operation and maintenance also includes effective performance, and <br /> adequate laboratory and process controls, including appropriate quality assurance procedures. This provision <br /> requires the operation of back-up or auxiliary facilities or similar systems when installed by the permittee only <br /> when necessary to achieve compliance with the conditions of the permit. <br /> Any sludge produced at the wastewater treatment facility shall be disposed of in accordance with State and <br /> Federal guidelines and regulations. The permittee shall take all reasonable steps to minimize or prevent any <br /> discharge of sludge use or disposal in violation of this permit which has a reasonable likelihood of adversely <br /> affecting human health or the environment. As necessary, accelerated or additional monitoring to determine the <br /> nature and impact of the noncomplying discharge is required. <br /> C. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS <br /> 1. Numeric Effluent Limitations and Site-Specific Monitoring (Outfalls 005, 007, 008, 009, 011, 012, 014, <br /> 015, 017, 025, 026, 027, 030, 032, 033, 034, and 035) <br /> In order to obtain an indication of the probable compliance or noncompliance with the effluent limitations <br /> specified in this part, the permittee shall monitor all effluent parameters at the frequencies and sample types <br />
