Any discharge to the waters of the State from a point source other than specifically authorized by this permit is prohibited. UST1A is an in-stream permitted feature located upstream from the facility discharge to collect continuous ambient temperature data at 38.90500' North latitude, 107.443056 West longitude. UST2A is an in-stream permitted feature located upstream from the facility discharge to collect continuous ambient temperature data at 38.88139' North latitude, 107.45102' West longitude. B. PERMIT COMPLIANCE In accordance with the Water Quality Control Commission Regulations for Effluent Limitations, Section 62.4, and the Colorado Discharge Permit System Regulations, Section 61.8(2), 5 C.C.R. 1002-61, and the federal Effluent Limitation Guideline for the Coal Mining Point Source (40 CFR 434), the permitted discharge shall not contain effluent parameter concentrations which exceed the limitations specified below or exceed the specified flow limitation. All discharges authorized under this permit shall comply with all the terms and conditions required by this permit. Violation of the terms and conditions specified in this permit may be subject to civil and criminal liability pursuant to sections 25-8-601 through 612, C.R.S.. Failure to take any required corrective actions, as detailed in the CORRECTIVE ACTIONS section, constitutes an independent, additional violation of this permit and may be subject to civil and criminal liability. Facilities Operation and Maintenance The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee as necessary to achieve compliance with the conditions of this permit. Proper operation and maintenance also includes effective performance, and adequate laboratory and process controls, including appropriate quality assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems when installed by the permittee only when necessary to achieve compliance with the conditions of the permit. Any sludge produced at the wastewater treatment facility shall be disposed of in accordance with State and Federal guidelines and regulations. The permittee shall take all reasonable steps to minimize or prevent any discharge of sludge use or disposal in violation of this permit which has a reasonable likelihood of adversely affecting human health or the environment. As necessary, accelerated or additional monitoring to determine the nature and impact of the noncomplying discharge is required. C. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS 1. Numeric Effluent Limitations and Site-Specific Monitoring (Outfalls 005, 007, 008, 009, 011, 012, 014, 015, 017, 025, 026, 027, 030, 032, 033, 034, and 035) In order to obtain an indication of the probable compliance or noncompliance with the effluent limitations specified in this part, the permittee shall monitor all effluent parameters at the frequencies and sample types
