An average transit loss of one percent was estimated and assessed to the required <br /> monthly replacement amounts, as shown in Tables 1 A-E. Transit losses will be assessed by <br /> the Water Commissioner and Division Engineer. Under Scenario A, estimated annual <br /> replacements are 35.33 acre-feet (January 2021 — December 2021) and 37.06 acre-feet <br /> (January 2022 — December 2022). Under Scenario B, estimated annual replacements are <br /> 34.36 acre-feet for the period (January 2021 — December 2021) and 35.41 acre-feet <br /> (January 2022 — December 2022). Under Scenario C, estimated annual replacements are <br /> 34.36 acre-feet for the period (January 2021 — December 2021) and 34.47 acre-feet <br /> (January 2022 — December 2022). Under Scenario D, estimated annual replacements are <br /> 28.96 acre-feet for the period (January 2021 — December 2021) and 25.54 acre-feet <br /> (January 2022 — December 2022). Under Scenario E, estimated annual replacements are <br /> 34.36 acre-feet for the period (January 2021 — December 2021) and 29.07 acre-feet <br /> (January 2022 — December 2022). <br /> CONDITIONS OF APPROVAL <br /> I hereby approve the proposed SWSP in accordance with §37-90-137(l 1), C.R.S., subject to <br /> the following conditions: <br /> 1. This SWSP shall be valid for the period of January 1, 2021 through December 31, <br /> 2022, unless otherwise revoked, or superseded by decree. If a court decreed plan for <br /> augmentation is not obtained for the proposed uses by the SWSP expiration date, a <br /> renewal request must be submitted to this office with the statutory fee (currently $257) <br /> by November 1, 2022. If a renewal request is received after the expiration date of this <br /> SWSP, it may be considered a request for a new SWSP, in which case a $1,593 filing fee will <br /> apply. <br /> 2. The maximum amount of groundwater exposed under this SWSP shall not exceed <br /> 9.76 acres. Documentation of pond size may be required by the Division Engineer in the <br /> form of an aerial photo evaluation or survey by a Professional Land Surveyor during the plan <br /> year or years covered by subsequent renewals of this SWSP. <br /> 3. The maximum annual evaporative loss associated with this mining operation shall <br /> not exceed 21.76 acre-feet under Scenario A, shall not exceed 34.26 acre-feet under <br /> Scenario B, shall not exceed 34.26 acre-feet under Scenario C, shall not exceed 17.30 <br /> acre-feet under Scenario D, and shall not exceed 34.26 acre-feet under Scenario E as listed <br /> on the attached Tables 1 A-E. <br /> 4. Under Scenario A, the maximum annual operational loss associated with this mining <br /> operation shall not exceed 7.86 acre-feet, as listed on the attached Table 1A. The total <br /> product mined at the St. Barbara Sand and Gravel Mine shall not exceed 210,000 tons per <br /> year resulting in an annual amount of 6.18 acre-feet of water lost in the mined aggregate. <br /> The annual amount of water used for dust suppression shall not exceed 1.68 acre-feet. <br /> Under Scenario B, the same limitations shall apply in 2022 and there shall be no operational <br /> loss associated with this mining operation in 2021, as listed on the attached Table 1 B. Under <br /> Scenario C, there shall be no operational loss associated with this mining operation, as <br /> listed on the attached Table 1 C. Under Scenario D, the same limitations shall apply as in <br /> Scenario A, as listed on the attached Table 1 D. Under Scenario E, the same limitations shall <br /> apply as in Scenario B, as listed on the attached Table 1 E. <br />
