PERMIT#:M-2008-076 <br /> INSPECTOR'S INITIALS: DC 1 <br /> INSPECTION DATE: January 13,2021 <br /> OBSERVATIONS <br /> The Robinson Sons Gravel Pit No.1 was inspected by an aerial fly-over conducted by the Division of <br /> Reclamation, Mining and Safety (Division/DRMS). The inspection was completed to determine if the <br /> reclamation required by the June 2020 Mined Land Reclamation Board order has been completed. The site <br /> was previously inspected by the Division on December 18, 2020 to determine if the Operator had completed <br /> enough reclamation to reduce the required surety down to what is currently held be the Division. <br /> The Operator is currently under a board order (Violation No. MV-2019-005) to complete corrective actions by <br /> December 27, 2020. The Board ordered permit M-2008-076 revoked and issued a cease and desist order for <br /> the operation. The Board imposed the following corrective action against Robinson: <br /> 1. By July 24, 2019, advance the reclamation of affected lands as necessary to ensure sufficiency of the <br /> existing $52,815.00 financial warranty; or <br /> 2. By July 24, 2019, submit to the Division the additional financial warranty in the amount of$120,915.00. <br /> Area 1: <br /> Based on the aerial photos taken on January 13, 2020, the operator has not made any progress since the <br /> December 18, 2020 inspection. The previously noted highwall is in place and the noted impoundment of water <br /> has not been breached in Area 1. During the December 18, 2020 inspection, it was noted that mining may <br /> have occurred in the western side of Area 1. While the Aerial photos do show additional material in this area, <br /> it does not appear that mining has occurred and it is unclear of where the additional material came from. The <br /> trash that was noted onsite during the previous DRMS inspection is still in place. <br /> Additional reclamation work, including backfilling, grading, drainage reestablishment, topsoiling, and <br /> revegetation will be required to comply with the reclamation plan. <br /> Area 2: <br /> The aerial photos of Area 2 shows no work has been conducted since the December 18th inspection. The <br /> stockpiles in this area are still there and no earthwork has been conducted. <br /> Area 3: <br /> The impoundments that were noted in Area 3 have been completely removed based on observations made <br /> from the aerial inspection and the December inspection. <br /> Conclusion: <br /> Enclosed is the Division's estimate of the current reclamation liability remaining at the site. Based on this <br /> estimate, the Operator has not completed enough reclamation to bring the liability to the currently held <br /> $52,.815.00 financial warranty amount. To date, the Operator has not provided additional financial warranty. <br /> Therefore, the Operator has not complied with the Board's order.
