Enforcement Actions <br /> There have been no enforcement actions issued since the last Midterm Review(MT7). <br /> The Review Process(RN7) <br /> For the current renewal(RN7),the Division notified Seneca Property,LLC by letter on 5 November 2019 <br /> that its permit for the Mine would expire on 31 December 2020. The letter explained that,for operations <br /> to continue beyond that date, Section 2.08.5(3)(f)requires an application for renewal to be received on or <br /> before 30 June 2020. Seneca Property LLC, submitted a renewal application on 26 June 2020 and the <br /> application was found complete on 2 July 2020. SPL published a notice of the application in the <br /> Steamboat Pilot,over the course of four consecutive weeks from 20 June through 11 July 2020. No <br /> objections regarding the application were received by DRMS. <br /> On 31 August 2020,the Division sent the preliminary adequacy letter to SPL requesting additional <br /> information with regards to portions of the permit. SPL provided responses to the Division's adequacy <br /> questions in a letter dated 19 November 2020,and received by the Division on the same date. Review of <br /> the operator's 19 November 2020 response resulted DRMS finding all adequacy questions had been <br /> resolved. <br /> The Office of Surface Mining's applicant violator system(AVS),was queried 11 September 2020 and no <br /> violations were identified. A follow up AVS query was conducted on 24 November 2020, and resulted in <br /> a recommendation to propose a decision for this renewal. <br /> The current bond held is$3,790,697.28, and is found to be adequate to complete reclamation of the site in <br /> accordance with the approved reclamation plan. <br /> All adequacy concerns have been resolved. Therefore,the Division proposes to approve the renewal <br /> application. Publication of this proposed decision initiates a thirty day public comment period. Provided <br /> there are no objections to the decision,the proposed decision will become final at the close of the <br /> comment period. <br /> Description of the Environment <br /> Location of Permit Area <br /> The operation is located approximately 7 miles south of Hayden,Colorado in Routt County as shown on <br /> Map 1 below, and is positioned between two existing coal mining operations. The Seneca IIW Mine is <br /> situated approximately 7 miles west of the Peabody Sage Creek Mine (C2009087),and 3.5 miles east of <br /> the Yoast Mine (C 1994082). The mining area is located between two formally permitted operations, <br /> Hayden Gulch Mine to the west and Grassy Creek Mine to the east. USGS Hayden,Hayden Gulch, <br /> Mount Harris and Dunkley Quadrangles 7.5 minute series maps each depict the mine. The legal <br /> description of the lands included within the permit area of the Seneca IIW Mine follows: <br /> TSN,R88W;All of Section 15;Portions of Sections 9, 10, 11, 14, 16,21,22,23,26,27, 34, and 35 <br /> T6N,R88W;Portions of Sections 14,23 and 24 and T6N,R87W;Portions of Sections 17, 18, 19. <br /> Geologic Setting <br /> Elevation of the general mine site varies from approximately 6400 to 8350 feet. Slopes range from about <br /> 2 percent to nearly 100 percent. The surficial geology of the area is composed chiefly of sedimentary <br /> rocks,of marine and non marine origin. These sedimentary rocks were formed through the transgression <br /> and regression of an epicontinental sea. Prominent ledges are formed by the Twentymile sandstone in the <br /> western permit area and the Trout Creek sandstone ledge in the eastern permit boundary.Many of the <br /> drainages are deeply incised. <br /> Page 4 of 37 <br />
