The amended weed management plan was submitted to comply with the State Noxious Weed <br /> Law and regulations, and to comply with new Rule 4.15.1(5). <br /> The proposed operation is in compliance with the requirements of this section <br /> MI. Post-mining Land Use <br /> The predominant pre mining land uses are rangeland, supporting domestic livestock <br /> grazing, and wildlife habitat. Secondary uses consist of a small industrial area (one active <br /> oil well) and minor water resources (stock ponds). These uses are depicted on Exhibit 4.1 <br /> and described in Volume I, Tab 4. After mining,the applicant plans to restore the pre- <br /> mining land uses. Post-mining land use is discussed in Volume 13,Tab 22 of the <br /> application. <br /> The applicant, during the original permit review, contacted the legal or equitable owners <br /> of record of the surface of the proposed permit area, and the State and local government <br /> agencies which would have to initiate,implement, approve or authorize the proposed use <br /> of the land following reclamation. The contacts were made by certified mail in order to <br /> solicit any concerns or comments for the proposed post mining land use plan (Tab 13),as <br /> required by Rule 2.05.5(1)(b). No objections to the proposed post mining land use were <br /> received. The original application proposed that the mine entrance haul road and Haul <br /> Road A, as well as the Oil Well Road, be retained in a reduced configuration for the post <br /> mine land use. Additional road segments have subsequently been proposed for retention <br /> in accordance with applicable road designs. Retained roads facilitate post mine <br /> management activities in the permit area. All proposed permanent roads are subject to <br /> the demonstrations specified in Stipulation 32. <br /> Existing sedimentation ponds and a number of existing and proposed stock ponds are <br /> proposed by SPL, and approved as permanent impoundments for the post mine land use by <br /> the State Engineers Office. The impoundments are warranted to facilitate post mine <br /> livestock grazing and wildlife use, and to replace water sources that existed prior to <br /> mining. However, all documentation required by Rule 4.05.9(13) has not been provided <br /> to allow for final approval off all proposed permanent hydrologic features. The following <br /> commitment is included in Permit Tab 13, page 5,regarding permanent impoundment <br /> demonstration of compliance: <br /> Permanent impoundments will be reevaluated prior to bond release and remedial <br /> construction performed to satisfy the appropriate sections of the regulations. Prior <br /> to submittal ofa bond release request, SPL will submit a complete technical revision <br /> demonstrating that each permanent impoundment meets the requirements of <br /> 4.05.9(13). <br /> The Division hereby approves the primary post mining land uses of rangeland and wildlife <br /> habitat, and of industrial use on the warehouse and oil well areas as the secondary land <br /> use (2.07.6(2)(1)). The proposed operation is in compliance with the requirements of this <br /> section. <br /> XIII. Protection of Fish, Wildlife and Related Environmental Values <br /> The fish and wildlife resources information is presented in Tab I I of Volume 6 of the <br /> permit application.
