July 2020 DE—RO01-191,M70257 <br /> equipment,tools,and improvements placed thereon by the Lessee,provided that the Lessee shall not remove any <br /> timbers or improvements which are determined by DOE to be required to be left in the mine�rorkings to protect <br /> such workings as a mining property. Furthennore,prior to the surrender of the Property,the Lessee shall remove <br /> from the Property,at Lessee's expense,all stockpiles of ore and protore materials placed thereon by the Lessee and <br /> remit the required royalties to DOE in accordance with Article V,"ROYALTIES,"within 60 days after the <br /> expiration or other termination of the Lease. DOE reserves all right and title to the Property in and to all ores and <br /> other uranium or vanadium-bearing material not removed from the Property. Unless DOE approves otherwise,all <br /> material mined from the Property and not marketed by Lessee shall remain on the Property. <br /> XXIV. EXAMINATION OF RECORDS. <br /> (a) DOE and the Comptroller General of the United States,or duly authorized representatives of <br /> either,shall have until seven(7)years after Final payment under this Lease,access to and the right to examine any <br /> of the Lessee's books,documents, papers,or other records related to this Lease. The Lessee shall make these <br /> records and documents available to the Government,at the Lessees offices,at all reasonable times,without any <br /> charge. <br /> (b) The Lessee agrees to include in first-tier subcontracts under this Lease a clause to the effect that <br /> DOE,the Comptroller General,or duly authorized representatives of either shall,have until seven(7)years after <br /> final payment under the subcontract,access to and the right to examine any of the subcontractor's books, <br /> documents,papers,or other records related to the subcontract. <br /> (c) The periods of access and examination in paragraphs(a)and(b)above for records relating to <br /> (1)appeals under Article XXV11,"DISPUTES,"(2) litigation or settlement of claims arising from the performance <br /> of this Lease,or(3)costs and expenses of this Lease to which DOE,the Comptroller Genera.,or duly authorized <br /> representatives of either has taken exception shall continue until such appeals, litigation,claims,or exceptions are <br /> disposed of. <br /> XXV. OFFICIALS NOT TO BENEFIT.No member of or delegate to Congress or resident commissioner shall <br /> be admitted to any share or part of this Lease,or to any benefit arising from it.However,this clause does not apply <br /> to this Lease to the extent that this Lease is made with a corporation for the corporation's general benefit. <br /> XXV. COVENANT AGAfNST CONTINGENT FEES.The Lessee warrants that no person or selling agency <br /> has been employed or retained to solicit or secure this Lease upon an agreement or understanding for a commission, <br /> percentage,brokerage,or contingent fee,excepting bona fide employees or bona fide established commercial or <br /> — ll — <br />
