July 2020 DB RO01--19f,M70257 <br /> (1) A site-specific environmental analysis <br /> (2) A description of specific measures to be taken to ensure compliance with the requirements of <br /> Article X1,"COMPLIANCE wITH STATUTES AND REGULATIONS,"including methods of <br /> reclamation contemplated by the Lessee <br /> (3) The specific information outlined in Appendix C of this Lease <br /> (b) All Exploration Plans submitted to DOE pursuant to this Article XII and all proposed activities <br /> contained therein shall be reviewed by DOE,in accordance with 10 C.F.R.Part 1021,"National Environmental <br /> Policy Act Implementing Procedures." <br /> (c) If preparation and filing of an Exploration Plan for the entire operation is dependent upon factors <br /> which cannot or will not be determined except during the progress of any exploration activities,partial plans may <br /> be submitted and approved from time to time;however,the Lessee shall not perform exploration activities not <br /> described in an approved plan. <br /> (d) Changes may be made in the approved Exploration Plan by mutual written agreement of the <br /> Lessee and DOE.Approval is contingent upon the Lessee notifying all other appropriate agencies(as outlined in <br /> Appendix C)of the proposed changes. <br /> (e) All costs associated with the Exploration Plan,including any approvals or permits,shall be borne <br /> solely by the Lessee. <br /> XI11. MINING PLAN. <br /> (a) Prior to constructing any surface installation or commencing mine development on the Property, <br /> the Lessee shall file with DOE,three(3)copies of a plan for the proposed mining operations and shall obtain <br /> DOE's approval of such plan(the"Mining Plan"). Such mining plan shall be consistent with the"Reclamation <br /> Permit Application"(hereinafter"Application")to be filed with the Colorado MLRB in accordance with Rule 1.4 <br /> and Rule 6 of the"Mineral Rules and Regulations"of the Colorado MLRB,as these rules may be amended,and <br /> any other applicable laws or regulations.The Alining Plan shall include all information required by the Application <br /> and, in addition,must specifically include the following information: <br /> (1) A site-specific environmental analysis(in support of an environmental assessment,at a <br /> minimum) <br /> -6 - <br />
