BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Notice of Violation No. MV-2020-021 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF POSSIBLE VIOLATIONS BY MINERAL MOUNTAIN GOLD, <br /> LLC, CEASE AND DESIST ORDER, CORRECTIVE ACTIONS, AND CIVIL <br /> PENALTIES FOR FAILURE TO COMPLY WITH THE CONDITIONS OF PERMIT <br /> M-2014-045 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> November 18, 2020 via video conference as a consent agenda item to consider <br /> modifications to the Board's Order dated October 8, 2020 and effective as of October <br /> 12, 2020. <br /> The Board, considered the materials presented with this consent agenda <br /> item and having been otherwise fully informed of the facts in the matter, enters <br /> the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 110(d) limited impact permit for a 9.21-acre gold <br /> mining operation located in Section 12, Township 15 South, Range 70 West, 6th <br /> Principal Meridian in Teller County, Colorado, permit number M-2014-045. The <br /> mine is known as the Mineral Mountain Project and is located approximately one <br /> mile north of Cripple Creek, Colorado. <br /> 2. On August 19, 2020, the Board found Operator in violation of section <br /> 34-32-124, C.R.S., for failure to comply with the permit. The Board issued an order <br /> which became effective on October 12, 2020 regarding the violation (the "Order"). <br /> 3. The Order imposed the following unresolved corrective actions on <br /> Operator: <br /> File an Amendment application updating the Mine Plan and <br /> Environmental Protection Plan to describe current and proposed <br /> mining and milling activities at the site. The Amendment shall be <br /> filed within sixty days of the mailing date of this Order, with all <br /> material in an approvable form within statutory deadlines. <br />
