Runoff from each parcel flows into <br />ditches and then to sedimentation ponds prior to water discharging from the site. Post mine drainage <br />channels are designed to control runoff and erosion. All channels are designed to control the 10 year 24 <br />hour flood event. One drainage (parcel 25), pond drainage areas and one ditch were included within the <br />bond release block as per the SL5 Phase I Bond Release Map submitted with the application. The channel <br />in parcel 25 reports to the 9-P2 and 9-P3 ponds in parcel 26. Slope and aspect are consistent with the <br />reclamation plan. Pond areas drainage ditches and channels were functional, stable and no problems were <br />noted at the time of the inspection. The lining in the mine water ditch was intact and the gradient and <br />size of the drainages met the design requirements of the permit. <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division finds that Moffat County Mining, LLC has completed backfilling, grading and drainage <br />reestablishment at the Williams Fork Mines in accordance with the approved reclamation plan. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Moffat County Mining, LLC's <br />request for a partial Phase I bond release for the Williams Fork Mines. This proposed decision will <br />release the applicant from liability for backfilling, grading, and drainage reestablishment (Phase I) as per <br />Rule 3.03.1(3)(b) for the 176.7 acres requested as per Map SL5 Phase I Bond Release as submitted with <br />the application package. <br />PHASE I <br />The Division holds a performance bond of $4,691,000.00 for the Williams Fork Mine. The current <br />liability for the site is $4,678,879.02. The total applicable bond for the 176.7 acre Phase I area is <br />$1,450,452.50: [(original performance bond/original acres of disturbance) * requested Phase I acres]. <br />$870,271.50 constitutes 60% of the amount releasable for Phase I reclamation of 176.7 acres. The <br />remaining $3,808,607.52 is sufficient to assure completion of the remaining reclamation work at the site <br />Permit Number. C1981044 Page 13 of 14 <br />
