The Order also required Operator to cease and desist: <br /> any further mining activities, except those activities approved by the <br /> Division in writing, as necessary to comply with the conditions of <br /> this Order, prevent damage to off-site areas, or to protect human <br /> health and safety, until Operator has completed the corrective <br /> actions set forth in this Order to the satisfaction of the Division. <br /> 5. On November 5, 2020, the Operator requested that the corrective <br /> actions in the Order be modified to extend the deadline for Operator to file an <br /> amendment application. Operator also requested that the cease and desist order be <br /> amended to allow exploratory mining, tunneling, and underground drilling. <br /> 6. The Division of Reclamation, Mining and Safety ("Division") does not <br /> oppose Operator's requests and recommends extending the deadline for Operator to <br /> file an amendment application to February 9, 2021. <br /> CONCLUSIONS OF LAW <br /> 7. The Board has jurisdiction over this matter pursuant to the Mined <br /> Land Reclamation Act, Article 32 of Title 34, C.R.S. (2020) ("Act"). <br /> ORDER <br /> Based on the foregoing findings of fact and conclusions of law, the Board <br /> hereby grants Mineral Mountain Gold, LLC's request for modifications to the Order <br /> as follows: <br /> Operator shall file an Amendment application updating the Mine Plan and <br /> Environmental Protection Plan to describe current and proposed mining and milling <br /> activities at the site. The Amendment shall be filed February 9, 2021, with all <br /> material in an approvable form within statutory deadlines. <br /> The Order is hereby amended to allow Operator to engage in exploratory <br /> mining, tunneling, and underground drilling.
