4. The Order also required Operator to cease and desist:
any further mining activities, except those activities approved by the
Division in writing, as necessary to comply with the conditions of
this Order, prevent damage to off-site areas, or to protect human
health and safety, until Operator has completed the corrective
actions set forth in this Order to the satisfaction of the Division.
5. On November 5, 2020, the Operator requested that the corrective
actions in the Order be modified to extend the deadline for Operator to file an
amendment application. Operator also requested that the cease and desist order be
amended to allow exploratory mining, tunneling, and underground drilling.
6. The Division of Reclamation, Mining and Safety ("Division") does not
oppose Operator's requests and recommends extending the deadline for Operator to
file an amendment application to February 9, 2021.
CONCLUSIONS OF LAW
7. The Board has jurisdiction over this matter pursuant to the Mined
Land Reclamation Act, Article 32 of Title 34, C.R.S. (2020) ("Act").
ORDER
Based on the foregoing findings of fact and conclusions of law, the Board
hereby grants Mineral Mountain Gold, LLC's request for modifications to the Order
as follows:
Operator shall file an Amendment application updating the Mine Plan and
Environmental Protection Plan to describe current and proposed mining and milling
activities at the site. The Amendment shall be filed February 9, 2021, with all
material in an approvable form within statutory deadlines.
The Order is hereby amended to allow Operator to engage in exploratory
mining, tunneling, and underground drilling.
