FebruaryL/2020 <br /> Colorado Division of Reclamation Mining& Safety <br /> 1313 Sherman Street,No. 215 <br /> Denver, Colorado 80203 <br /> Re: Reclamation at Hitch Rack Ranch;2485 Hitch Rack Ranch Road,Colorado Springs,CO. <br /> To whom it may concern: <br /> RMBC Group,L.L.C.,a Colorado limited liability company owns the surface estate of certain <br /> real property located at 2485 Hitch Rack Ranch Road,Colorado Springs,El Paso County, <br /> Colorado (the"Hitch Rack Ranch"or"Ranch"). As you may know,Castle Concrete Company, <br /> a Colorado corporation dba Castle Aggregates(formerly known as Transit Mix Concrete Co., <br /> hereinafter"Castle"),conducted certain discrete mining exploration activities at the Hitch Rack <br /> Ranch in connection with the pursuit of a 112 construction materials reclamation permit(File <br /> Number M-2016-010). These activities included the construction of certain access roads and the <br /> installation of five monitoring wells. <br /> The purpose of this letter is to inform the Division that RMBC has no objections regarding <br /> reclamation at the Ranch and its discussions with Castle regarding the same. <br /> RMBC has no objection to the access roads and all of the monitoring wells currently on the <br /> Ranch property,and RMBC does not object to having the access roads and the monitoring wells <br /> remain in place,as they are, on the Ranch. Castle has been informed of RMBC's lack of <br /> objection to keeping both the access roads and monitoring wells in place on the Ranch. <br /> RMBC does not object,for all purposes,to Castle's performance with respect to the Ranch and <br /> believes that final reclamation has been completed pursuant to Mineral Rules and Regulations of <br /> the Colorado Mined Land Reclamation Board for the Extraction of Construction Materials,2 <br /> C.C.R. 407-4:1.1 et seq., including Rules 3 and 5,and Colorado Land Reclamation Act for the <br /> Extraction of Construction Materials, C.R.S.3432.5101 et seq. including Section 34-32.5-113. <br /> Please contact me if you need further information regarding these issues. <br /> Sincerely, <br /> Cindi Allmen ' anag r <br /> RMBC Group, L.L.C. <br />
