t <br /> PERMIT#:M-1995-005 <br /> INSPECTOR'S MTIALS:ACY <br /> INSPECTION DATE:December 15,2020 <br /> OBSERVATIONS <br /> This inspection was conducted in response to the succession of operator request that was approved on July 31, <br /> 2020. The inspection was conducted by Amy Yeldell of the Colorado Division of Reclamation, Mining and <br /> Safety(Division). The Orchard Mesa Aggr site is a 112c permitted site that includes a total of 46.10 acres. The <br /> site located southeast of Grand Junction, Colorado and is accessed through the Mesa County Landfill. David <br /> Forenza of Mesa Agg LLC represented the operator. Additional parties present were Ivan Geer, Bailie <br /> Tomlinson, Steve Baker and Robbie Stewardson. <br /> The mine identification sign and affected area boundary markers are in place and in compliance with Rule <br /> 3.1.12. A sign is attached to the main gate at the permit entrance from the county landfill. The sign has been <br /> updated to reflect the new Operator. The permit boundary is delineated by fences and/or t-posts. More frequent <br /> boundary delineations may be useful as mining progresses to the west. A scale and scale house is located along <br /> the mine access road near the gate to the composting area of the county landfill. <br /> Significant mining progress has been made since the acquisition of the permit. Approximately 5 acres has <br /> recently been mined since the previous inspection. Active near vertical highwall remains at approximately 2,000 <br /> linear feet. Excavations near the north side of the pit are averaging closer to 20 feet as compared to 10-15 feet <br /> along the south side of the pit where previous mining occurred. <br /> There is a large crushed gravel pile in the center of the pit. Smaller piles of overburden, fines and topsoil stored <br /> to west in the newly excavated areas. Mr. Forenza estimates that the pit is producing150 trucks per day. The <br /> ramp along the north side of the pit has been improved. It is now a more gradual slope and approximately 24 ft <br /> wide. <br /> Several pieces of equipment were observed on site. Fuel is currently stored in a mobile double walled tank. <br /> There is no water source on site and therefor no washing occurs. Portable water tanks were on site but <br /> applications of water for dust suppression was no observed. <br /> A large portion of the time spent on site was giving the new Operator an overview of DRMS. Resources such as <br /> ePermitting, Laserfiche and eNotify were mentioned. Additionally the Operator intends to submit an <br /> amendment to expand the pit in the near future. They are currently working through the county process right <br /> now. Moreover a portion of the expansion may be on BLM which will have additional permitting actions to <br /> work through prior to filing with DRMS. The Operator was encouraged to obtain the necessary other permit(s) <br /> prior to filing with DRMS given our deadlines are generally a tighter turn around for permit review. In the <br /> meantime if the Operator intends to conduct exploration activities in support of the future operations a Notice of <br /> Intent should be filed. <br /> Currently this site is not approved for the import of fill material. In order to import material the Operator must <br /> provide the Division with notice per Rule 3.1.5 (9). The notice shall include but is not limited to: a narrative <br /> that describes the approximate location of the proposed activity; the approximate volume of inert material to be <br /> backfilled; a signed affidavit certifying that the material is clean and inert, as defined in Rule 1.1(20);the <br /> approximate dates the proposed activity will commence and end, however, such dates shall not be an <br /> enforceable condition; an explanation of how the backfilled site will result in a post-mining configuration that is <br /> compatible with the approved post-mining land use; and a general engineering plan stat how the material will be <br /> place and stabilized in a manner to avoid unacceptable settling and voids."This Notice should be submitted in <br /> the form of a technical revision. <br /> Page 2 of 6 <br />
