BMRI is not seeking
any financial warranty release at this time.
Permit Reduction
The Permit Area is currently 736.92 acres and is shown on Exhibit 1. BMRI requests to reduce
the Permit Area by 315.6 acres. The requested release areas are divided into Areas A, B, C, and
D (Exhibit 1). Area A consists of 59.0 undisturbed acres and the previously reclaimed "Waste
Rock B" area which is 18.0 acres, totaling 77.0 acres. Area B consists of the unpaved haul road
from the water treatment facility to the TSF totaling 9.5 acres. The Haul Road was declared an
access easement in the 1997 plat survey included in Technical Revision 25 and is not required to
be reclaimed. The plat survey is included as Exhibit 2.
A reduction of 315.6 acres from the existing Permit Area (736.92 acres) would result in a new
Permit Area of 421.32 acres. The Proposed Permit Area is shown on Exhibit 3.
