Peabody Seneca Property, LLC <br />2.03.10 Identification of Licenses and Permits <br />7. DRMS: Adjudication File Table of Contents states that Current Licenses and Permits are <br />listed on page 12. No such listing exists on page 12. Please add this information and <br />update the table of contents accordingly. <br />a. The pages and table of contents have been updated and now reflect each other. <br />8. DRMS: Please check for any changes to this information and update with revised pages <br />if necessary. <br />a. The Current Licenses and Permits are up to date in the revised Tab 3 attached. <br />2.03.12 Proof of Publication <br />9. DRMS: Please submit Proof of publication for this permitting action (RN7). <br />a. The POP is attached to this submittal. <br />2.04.3 General Reauirements: Site Description and Land Use Information <br />10. DRMS: On page 12, it is stated that Exhibit 4-1 covers 4,093 acres. Please update to <br />reflect the current mine permit acreage of 3878.5 acres. <br />a. Page 12 has been updated with the correct acreage since moving the Tie across <br />Haul Road to the Hayden Gulch Permit. <br />11. DRMS could not locate Exhibit 4-1 in the permit file. Please provide this exhibit. <br />a. SPL was able to locate Exhibit 4-1 in Laserfiche but has also attached a copy to <br />this submittal. <br />2,05.4 (2)(b) Reclamation Cost Estimate <br />12. DRMS conducted a reclamation cost estimate for the site and found that the liability to <br />reclaim the Seneca IIW Mine to be $4,499,919.00. The currently held surety is <br />$3,790,697.28. Given this, the bond held is not adequate at this time. Attached is a copy <br />of the reclamation cost estimate conducted, it includes a Cost Summary, Task Summary <br />and CIRCES task sheets. The cost increase is largely due to the fact that the previous cost <br />estimate used for Midterm 07 was not updated at the time. <br />a. Since SPL currently has Bond Releases (SL6 & SL7) being processed, SLP would <br />like to wait until these permitting items are complete before adjusting liability <br />bond amount. <br />2.05.6(2) Fish and Wildlife Plan <br />13. DRMS: Please ensure the Threatened and Endangered Species listed in Tab 11, <br />Appendix 11-1 Potential and Observed Species List is up to date with the current list <br />issued by Federal and State agencies in accordance with Rule 2.04.11(4). <br />a.
