Rule 2.03.4: Identification of Interests <br />DRMS December 2020 <br />Trapper Mine updated this section of the permit with revised information. This rule is adequately met. <br />Rule 2.10: Maps and Plans <br />DRMS December 2020 <br />Trapper Mine updated this section of the permit with revised and new maps. This rule is adequately met. <br />Rule 4.05.2: Water Quality Standards <br />DRMS December 2020 <br />DRMS reviewed Trappers updated NPDES permit against submitted revised pages for adherence to water quality <br />standards, monitoring and effluent limitations. DRMS finds that TMI, through its management of the sedimentation <br />pond system in place at the site meet the requirements of the above mentioned rule and the intent of the NPDES <br />permit. <br />This rule is adequately met. <br />Rule 4.05.9(3): Impoundments <br />DRMS December 2020 <br />DRMS reviewed Trappers updates to the Coyote Pond comprising a change in the elevation of the primary spillway. <br />DRMS finds that the updated design provides adequate capacity per the above mentioned rule and that all required <br />documentation including as built designs and hydrologic modeling were provided. As Coyote Pond meets the size <br />criteria of 30 CFR 77.21(A), TMI submitted a letter from the MSHA District Manager stating that the design change <br />meet the specifications for the structure as per MSHA rules. <br />This rule is adequately met. <br />Rule 4.05.13 (1) and (2): Surface and Ground Water Monitoring <br />DRMS December 2020 <br />It appears from the submitted pages relevant to Trappers updated NPDES permit, that monitoring requirements as set <br />forth by the Division of Water Quality's permit for Trapper Mine have been incorporated into the permit with this <br />permitting action. <br />Also, as built information were submitted for the four new groundwater wells installed as per a previous and approved <br />permitting action. <br />This rule is adequately met. <br />Rule 4.15.Revegetaion <br />DRMS December 2020 <br />With respect to Trappers updated forb diversity standard and measurement, DRMS finds that this <br />rule is adequately addressed with the revised pages submitted. <br />All adequacy items have been satisfactorily addressed and The Division has no further questions. <br />A decision will be proposed on the date of publication, scheduled for 23 December. <br />
