features for the Yoast Mine were approved under Technical Revision No's. 37 and 49 (TR37 and <br /> TR49) on 4 December 2008 and 16 September 2010, respectively. Access roads include road(s) A <br /> and B (road B becomes road LU-3A). Light use roads include LU1, LU2, LU3A, LU4, and LU5. The <br /> roads approved for permanent retention were deemed necessary to support the post-mining land use <br /> and are utilized by property owners for access. <br /> The Division approved permanent pond demonstrations for three of the five remaining sediment <br /> ponds. Sediment ponds 10, 13, and 14 as well as two small livestock/wildlife stock tanks; Stock Tanks <br /> 1 and I IA have received approval from the Division to remain as permanent features. Ponds 12, 12A, <br /> 13 and 14 receive runoff from the SL8 bond release area. Permanent ponds have met the criteria <br /> specified under Rule 4.05.9(13) and were deemed necessary to support the post-mining land use. <br /> Ponds 10, and stock tank 1 achieved phase I release in SL4 and constitute approximately 0.7 and 0.2 <br /> acres respectively that will not be backfilled and graded. Stock Tankl IA(0.2 acres), and its associated <br /> drainage and Ponds 13 and 14 comprised the SL6 partial Phase I bond release and constitute 0.7 acres <br /> each, for a total of 1.6 acres which will not undergo backfilling and grading. Both ponds 13 and 14 <br /> received phase I bond release in the SL6 permitting action. Pond 14 has been permitted as a permanent <br /> impoundment in its current configuration as has Stock Tank I IA. <br /> The Pond 10 watershed has previously been released. The Pond 12 watershed area includes a portion of <br /> the South Pit and the Neck Pit mining areas. These areas were to be graded to approximate original <br /> contour,as depicted in the approved Exhibit 20-2 of the Permit Application Package (PAP),their <br /> drainages reestablished, and the areas were to be topsoiled and reseeded. <br /> The Pond 12 watershed area was originally part of the SL4 bond release request;however, during the <br /> adequacy review of the SL4 bond release application,the Division determined that this area was not <br /> eligible for Phase I bond release. In early July 2012, a major rainfall event occurred in the Yoast Mine <br /> area,resulting in widespread damage to the south mine post-mining drainage channels. The YPM-5-1, <br /> YPM-6-2,YPM-6-3 YPM-7, and YPM-7A, drainages and watersheds, all draining to the Pond 12 <br /> watershed,required reconstruction and were excluded from the SL4 bond release. <br /> The Pond 12 watershed area also included the north inslope of Pond 12, including the Pond 012 slide <br /> area. Major landslides have occurred in the Pond 12 slide area on four separate occasions dating back to <br /> 2006, and minor slumps and sloughing had been ongoing through 2011. In 2011, SPL completed the <br /> regrading and drainage installation portion of the approved slide remediation plan (Technical Revision <br /> No. 46). The Pond 12A and Pond 14 watersheds were phase II and phase III released with SL7. <br /> For the Pond 13 Slide Area no reclamation is required, as it has been permitted as a permanent <br /> impoundment in its current configuration. Pond 13 was not previously considered for Phase I bond <br /> release as it was within the Pond 13 slide area parcel that was required to be observed for at least one year <br /> following the 2012 slide activities prior to being eligible for bond release.
