ERC West Farm Pit Expansion Project Site <br /> Threatened-Endangered Species and General Wildlife Screening <br /> are protected by the Bald and Golden Eagle Act and destruction of these nest require a permit <br /> whether they are occupied or not. ERC recommends that prior to vegetation removal, a nest <br /> survey for potential raptor species be performed during the nesting season to ensure that active <br /> nests are not disturbed. <br /> 4. No federal or state listed threatened and endangered species and/or habitat protected under the ESA <br /> or state regulations were identified within the survey area. The survey area is not within designated <br /> critical habitat of any federally listed species. The vegetation community and features within the <br /> survey area were investigated as potential habitat for federally listed species. Potential threatened <br /> and endangered species habitat was found to lack one or more habitat components critical for the <br /> federally listed species likely to occur in the area. Furthermore, connectivity to known populations <br /> was limited due to geographic, hydrologic, and other habitat constraints. Therefore, the project will <br /> not likely adversely affect federal listed species, their habitats, or proposed or designated critical <br /> habitat.
