The Division <br /> currently holds a corporate surety in the amount of$1,379,988.51. The most recent update of the <br /> reclamation liability for the Yoast Mine was completed 21 August 2020 for the Permit Renewal No. 5 <br /> (RN5) review process. The current amount of surety required to reclaim the site as per RN5 is <br /> $1,002,576.30. <br /> For Phase II bond release,Rule 3.03.1(2)(b) states that up to 85% of the bond amount shall be released <br /> when the permittee has successfully established vegetation supporting the approved post mining land use. <br /> Phase I release has been previously achieved on these parcels,releasing up to 60% of the liability. <br /> $3,057,413.40 constitutes 60% of the original liability for the 850.5 acres of original disturbance. The <br /> Phase II SL8 bond release area, is eligible for an additional 25%reduction in liability per Rule <br /> 3.03.1(2)(b). <br /> The total applicable bond for the 193 acre Phase II area is $1,156,340.95: [(original performance <br /> bond/original acres of disturbance) * requested Phase II acres]. $289,085.24 constitutes 25% of the <br /> amount releasable (25%of$1,156,340.95) for Phase II reclamation of 193 acres. <br /> The Division proposes releasing $289,085.24 associated with the Phase II portions of this SL8 bond <br /> release. The remaining $713,491.06 is sufficient to assure completion of the remaining reclamation work <br /> at the site if the work had to be performed by the Division, including the cost of reestablishing vegetation <br /> on any revegetated areas, should those areas fail. <br /> Any person with a valid legal interest which might be adversely affected by this proposed decision may <br /> request a formal public hearing before the Mined Land Reclamation Board in accordance with <br /> Rule3.03.2(6). Public notice of this proposed decision will be published twice in the Steamboat Pilot as <br /> soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty <br /> days of the first publication in the Steamboat Pilot.
