The Division received your completed "Need for a Reclamation <br /> Permit" questionnaire on November 24, 2020. The Division has assigned file number M-2020- <br /> 060 to the proposed project. Please display the file number on any correspondence regarding <br /> this specific project. <br /> Based on the information you submitted the purpose of the project is to remove historical mine <br /> dumps created between 1880 and the 1920's from the Penn Mine to recover tow grade gold and <br /> silver. The mine dump material will be excavated with front end loaders and hauled off site for <br /> processing with haul trucks. The material is proposed to be processed at the Leadvitte Mitt which <br /> is located approximately 6 miles from the Penn Mine. No new roads are proposed to be built to <br /> support this project. The total approximate surface disturbance is 25 acres and approximately <br /> 200,000 cubic yards of material will be removed and processed. The various metals recovered <br /> in the milling process will be sold. <br /> The Colorado Mined Land Reclamation Board (Board) has requested the Division make <br /> preliminary determinations regarding the need for a mined land reclamation permit. 'Based on <br /> the information provided in your response, it is the Division's opinion, based on the Board's <br /> past rulings, that the project is a mining, operation. Pursuant to Colorado taw, you are required <br /> to first obtain a mined [and reclamation permit from the Board prior to initiating the mining <br /> operation. <br /> If you have any concerns or disagree with this decision, you may petition the Board during a <br /> format public hearing for a format Declaratory Order concerning this matter. The request must <br /> be made in writing and received no later than 10 days prior to the next regular scheduled MLRB <br /> hearing.
