A request for extension of the permit term requires a public hearing and <br /> rec:omrnt:ndation by the Planning Commission and review and public hearing by the <br /> Board of Concjos County Commissioners. Any such request shall be made within the <br /> final eighteen(I R)months of this permit and shall be.rulrjcti:t to the Land Use Codc's <br /> application for a new special use permit procedure. <br /> IV Transfer of Ownership: Any permit for land use and mining approved in compliance <br /> with the Concjos County Land Use Code shall tx.binding upon the applicant. <br /> applicant's heir,and applicant's assigns, further,this shall be construed m a covenant <br /> that runs with the land during the time the permit is to effect.The transfer of this <br /> permit to any new owner may occur only after a statement has be filed with the <br /> Concjos County Land I Ise Office by the transferee indicating that it/hc'shc will <br /> comply with the terms and conditions of this permit. <br /> V Change in Conditions of Permit:C ales-,otherwise provided in the Concjos County <br /> Land Use Co dc,my ptopxosal to change the permit conditions shall require a new <br /> Special Use Permit. <br /> VI.Violations of Conditions of Permit: Failure to comply with these permit conditions <br /> shall cause the permit to he revoked by the Board of the Concjos County <br /> Commissioners pursuant to the procedures set forth in Article 16 of the Concjos <br /> County Land Use Code. <br /> V 11. Complaint Procedure: In the event that a formal written complaint is made <br /> concerning the operation,the Applicants shall initially handle the complaint. If the <br /> formal complaint is filed with Concjos County,the County shall,within 7 days, <br /> transmit the complaint to the Applicants.The Applicants and the County Land Use <br /> Office may meet with the complainant to resolve the complaint.The Applicants shall <br /> provide a written response to the complaint within 21 days of receiving the complaint. <br /> If the complaint cannot be resolved,the complaint will be referred to the Planning <br /> Commissinn,who shall review the complaint and offer recommendations to the <br /> Board of County Comtnissionerc. The Board of County Commissioners shall then <br /> hold a hearing to determine the merits of the complaint. the Applicants and the <br /> County should strive to handle the complaint in a fair,transparent,and timely <br /> manner. <br /> Vlll.
