The <br /> owners, Mr. and Mrs. Patrick Conley, have requested that CAS remove the old, abandoned railbed located <br /> just inside the north boundary of their property. The railbed varies in height and width and consists of base <br /> course and ballast, all placed directly on the natural surface(which apparently was not even stripped when <br /> the railroad was built. Since these are construction materials which have already been mined elsewhere <br /> and used here, I suppose this might be considered a deconstruction and recycling project. The cost of <br /> deconstructing the railbed would be offset for the Conleys by CAS paying them for the value of the reclaimed <br /> material, which it will then sell or use in its own projects. CAS plans to rent a mobile screening/crushing <br /> unit (wheeled or tracked)which would move down the roadbed from west to east, while a front-end loader <br /> feeds it, and there will probably need to have a stockpile/work area in the NW corner of the property. Either <br /> CAS or the landowners will rip and otherwise prepare the original surface after the roadbed is moved, and <br /> plant that to crops,together with the rest of the parcel.The landowners may keep a small amount of material <br /> for their own future use on the parcel. This would be a very short, single operation in a single season. <br /> Please find attached the latest version of the"Is it mining" questionnaire, with attached map. There is not a <br /> County approval document, as due to the nature of La Plata County Land Use requirements, we need to <br /> know if a reclamation permit is required in order to determine what County permit(s) to request. We are <br /> aware and certain that this project, including access by County Road, will be overseen by La Platte County. <br /> Due to the nature of the project, it is difficult to estimate quantities, depths, and other aspects, but the <br /> attached form provides as much information as we can. <br /> We expect that inquiries and complaints may be received by the Division and other agencies, and wish to <br /> assist as much as possible to provide accurate and complete information and answers to concerns. It is <br /> the intent of the owner and user of the property to protect and improve the environment and their land. <br /> The project is not located in a delineated wetland, delineated floodplain or any significant habitat. There is <br /> a drainageway (intermittent stream) at the extreme east end, which will be protected. <br /> We will keep the Division informed as to progress and any contacts which might fall within the Division's <br /> jurisdiction. <br /> Sincerely, <br /> Nathan A.
