SECTION III— STATUS OF STIPULATIONS <br /> No stipulations have been terminated or added to Permit C-1992-081 since the last permit <br /> renewal (RN-05). The permit has one active stipulation, attached to TR-10 as follows: <br /> Stipulation 9: The permittee shall submit a technical revision and receive approval to <br /> the permit to establish a post-mining land use reclamation plan, measurement <br /> methodologies, and reclamation success requirements for lands associated with the Tie- <br /> Across Haul Road with the approved post-mining land use of Cropland. <br /> Prior to initiation of reclamation for lands associated with the Tie Across Haul Road, the <br /> permittee shall submit a technical revision to the permit which provides a reclamation <br /> plan, sampling methodologies and reclamation success requirements for the cropland <br /> areas in accordance with Rule 2.05.4(2)(e), Rule 4.15.1(2)(c), Rule 4.15.9 and Rule <br /> 4.15.7(2). The technical revision needs to be approved prior to initiation of reclamation <br /> activities associated with the Tie Across Haul Road cropland areas. <br /> SECTION V—PERMIT VARIANCES AND SPECIFIC APPROVALS <br /> There are no specific variances and approvals by the Division for the Hayden Gulch Loadout. <br /> SECTION VI—BONDING SUMMARY <br /> As of November 20,2020, the Division estimates liability at the Hayden Gulch Loadout is <br /> $1,362,839.00 this amount is sufficient to assure completion of the remaining reclamation work <br /> at the site if the work had to be performed by the Division, including the cost of re-establishing <br /> vegetation on any revegetated areas, should those areas fail. The permittee currently has on <br /> deposit with the Division two Travelers Casualty and Surety Company of America bonds in the <br /> amount of$1,107,240.91. <br /> SECTION IV—MIDTERM ADEQUACY QUESTIONS <br /> Pursuant to 2.08.3, the Division finds that the permit application C-1992-081 contains four <br /> deficiencies following the review for the purpose of fulfilling the requirements of the Colorado <br /> Surface Coal Mining Reclamation Act, and the Regulations of the Colorado Mined Land <br /> Reclamation Board for Coal Mining. <br /> Item 1: In accordance with Rule 2.03.3(1), Tab 1 of the permit should be updated to reflect the <br /> current and future status of the loadout and the tie across haul road. <br /> Item 2: Please assure that Ownership and Control information is up-to-date. <br /> Item 3: As per Rule 2.03.6,please assure that all Right of Entry agreements remain current <br /> through the permit term. <br /> Hayden Gulch Loadout -4- 11/20/2020 <br />
