Appropriate fire protection and spill response kits were observed. <br />PROCESSING WASTE/COAL MINE WASTE PILES — Rule 4.10 and 4.11 <br />Drainage Control; Surface Stabilization; Placement: <br />Refuse was not actively being placed at either the upper or lower refuse piles located at the King I facility. <br />The areas were inspected however and both refuse storage areas are in good condition, well compacted and appear <br />to be within the design criteria for the facilities. The refuse storage areas were in excellent condition and were <br />stable at the time of the inspection. Both areas can be seen in Photos Nine and Ten. A depression near the <br />northeast corner of the upper refuse pile was observed during the previous inspection as a maintenance item that <br />should be worked to prevent the impounding of surface runoff. Conversations with the Operator indicate that the <br />depression was intentional and will become the footprint of the access road as refuse deposition continues. This is <br />no longer considered a problem at this time. <br />SIGNS AND MARKERS — Rule 4.02: <br />The appropriate mine identification signage and boundary markers were observed at both the King I and II <br />facilities. <br />TOPSOIL — Rule 4.06 <br />Removal 4.06.2; Substitute Materials 4.06.4(4); Storage and Protection 4.06.3; Redistribution 4.06.4: <br />The topsoil stockpile located at the King II facility was noted to have small areas that were void of <br />vegetation during the previous inspection and was considered a maintenance item. The Operator has since hand <br />scarified and seeded all areas that were void or lacking vegetative cover on the topsoil stockpile. Evidence of hand <br />scarification, seeding and hand application of mulch was observed. The areas will be monitored for vegetation <br />establishment, but this item is no longer considered a maintenance item. The remainder of the topsoil stockpile is <br />in excellent condition, well vegetated, and free from any state listed noxious weeds. <br />ENFORCEMENT ACTIONS/COMPLIANCE <br />No enforcement actions were initiated as a result of this inspection, nor are any pending. <br />Number of Partial Inspection this Fiscal Year: 3 <br />Number of Complete Inspections this Fiscal Year: 2 <br />Page 4 of 10 <br />
