<br /> <br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve <br />Bond Release Application No. 11 (SL-11) for the West Elk Mine, Permit No. C-1980-007. SL-11 <br />releases 15.25 acres reclaimed between 2002 and 2006 of Phase III liability. These acres previously <br />received Phase I and Phase II bond release with SL-03 and SL-04 respectively. The underground <br />operation is operated by Mountain Coal Company, LLC under the provisions of the Colorado <br />Surface Coal Mining Reclamation Act of 1979. The bond release application was submitted by <br />Mountain Coal Company, LLC on September 6, 2018. SL-11 seeks phase III bond release for <br />reclamation of drill pads and roads in the West Flatiron area. The affected area is located in Delta, <br />Gunnison County, approximately 9 miles East of Paonia, Colorado. <br /> <br />Copies of the proposed decision are available for review at <br />https://dnrweblink.state.co.us/drms/search.aspx by searching C1980007 in the “Permit No” field. <br />A user guide is available to help first time users of the imaged document system and can be viewed <br />at https://drive.google.com/file/d/1l8OUdf_Mpjo3kxIHkP5hMH-w7MeBtxX7/view.. <br /> <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision.
