BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Notice of Violation No. MV-2020-24 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF A POSSIBLE VIOLATION BY SALISBURY GLADSTONE <br />LLC, CORRECTIVE ACTIONS, CEASE AND DESIST ORDER, AND CIVIL <br />PENALTIES FOR FAILING TO OBTAIN A RECLAMATION PERMIT PRIOR TO <br />ENGAGING IN A NEW MINING OPERATION, File No. M-2020-030 <br />THIS MATTER came before the Mined Land Reclamation Board (Board") <br />on September 23, 2020 via videoconference as a consent agenda item to consider a <br />possible violation by Salisbury Gladstone LLC ("Operator''), cease and desist order, <br />corrective action, and a civil penalty for failing to obtain a reclamation permit <br />before engaging in a new mining operation, file number M-2020-030. <br />The Board, having considered the materials presented with this consent <br />agenda item and having been otherwise fully informed of the facts in the matter, <br />enters the following: <br />FINDINGS OF FACT <br />1. Operator submitted an application to the Division for a 110(1) Hard <br />Rock Limited Impact permit. The site is custom milling operation located in Section <br />34, Township 3 South, Range 72 West, Bth Principal Meridian in Clear Creek <br />County, Colorado. <br />2. On July 27, 2020, the Division of Reclamation, Mining and Safety <br />("Division") received an anonymous complaint stating that Operator was pouring a <br />foundation for a ball mill. <br />3. On August 3, 2020, the Division determined that Operator's <br />application was complete for filing and established a decision date of September 2, <br />2020. <br />4. On August 4, 2020, the Division inspected the site and determined that <br />Operator had begun construction of a ball mill and sediment containment structure <br />prior to the Division issuing a reclamation permit for the site. <br />b. On August 11, 2020, the Division determined that the application for a <br />110(1) permit submitted by Operator was a designated mining operation. <br />
