NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Mining and Safety proposes to approve Permit Revision Application No. 10, submitted by GCC Energy, LLC for a coal mining permit at the King Coal Mine (Permit No. C-1981-035). This revision proposes to add private and federally owned parcels included in Federal Coal Lease COC-78825 to the permit area.These parcels are located within portions of Township 35 North, Range 11 West Section 18, Township 35 North, Range 12 West Section 13, Section 22, Section 23, Section 26, and The King Coal Mine is a/an underground operation located in La Plata County, approximately 6 miles Southwest of Hesperus, Colorado. Coal interest is federal, state and private, and the surface to be affected is federal, state and private land. The permit area encompasses approximately 2,705.40 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the regulations promulgated thereunder. Copies of the proposed decision, including any stipulations, are on file for public inspection at the La Plata County Clerk and Recorder, 98 Everett St., Suite C, Durango, CO 81303. Such request must be made within thirty (30) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
