Peabodq <br />Hayden Gulch Terminal, LLC <br />October 21, 2020 <br />To: <br />RE: Hayden Gulch Loadout SL2, Phase I, II, & III Bond Release Application: <br />To Whom It May Concern: <br />You are receiving this notification as a requirement by the Colorado Division of Reclamation, Mining <br />and Safety (CDRMS). Pursuit to rule 3.03.2 of CDRMS regulations Hayden Gulch Terminal, LLC is <br />required to notify all adjoining property owners, surface owners, appropriate local government bodies, <br />municipalities, regional planning commissions, boards of county commissioners, county planning <br />agencies, sewage and water treatment authorities, and water conservancy and water conservation <br />districts in the locality in which the mining operations took place. <br />Hayden Gulch Terminal, LLC, 29515 Routt County Road 27, Oak Creek, Colorado 80467, has <br />requested release of Phase I, II, and III Liability on 170.3 acres of its reclaimed lands at the Hayden <br />Gulch Loadout (CDRMS Permit No. C 1992-081, approved May 22, 1993). These lands are in <br />association with the Sage Creek Recreation Trail managed by the Town of Hayden <br />The Hayden Gulch Loadout is located approximately 1.5 miles south of the Town of Hayden, <br />Colorado. The specific area to which this bond release request applies within the Permit Area is <br />located as follows: <br />T6NR88W: <br />Section 10 — Portions of. SENE, NESE, and SESE <br />Section 14 — Portions of: NWNW, SWNW, SENW, AND SW 1/4 <br />Section 15 — Portions of. NENE <br />The Hayden Gulch Loadout permit area consist of 391 acres. The USGS 7.5 Minute Quadrangle <br />Map Mount Harris, Colorado contains the described affected area. Pursuant to Rule 3.03.1, a <br />permittee may request Bond Release upon completion of all surface mining operations in <br />accordance with the approved reclamation plan, and the final inspection and procedures of Rule <br />3.03.2 have been satisfied. The approved reclamation plan can be viewed in its entirety in the <br />Hayden Gulch Loadout Permit Application Package located at the Foidel Creek Mine Office, 29515 <br />RCR 27, Oak Creek, Colorado 80467. Two Corporate Surety Bonds totaling $1,107,240.91 are <br />currently in place of which the bond amount to be released by this request will be determined by the <br />Colorado Division of Reclamation, Mining and Safety. <br />Hayden Gulch Terminal, LLC . 29515 Routt County Road #27 .
