The inspection was conducted on September 17, 2020 at approximately
11:30 AM. Clayton Wein of the Division was present for the inspection. Tyra Bartuska of United Companies
accompanied the inspection. The weather was clear with a temperature of 70 degrees F. The ground
conditions were dry. The inspection was conducted after an acreage reduction application, AR -01, was
received by the Division. The application requested a total of 37.1 acres that includes all of the Phase II mining
area and a portion of the Phase I mining area. The permitted mine area is 60 acres.
At 1:30 PM Clayton Wein representing the Division met with Brad Ocker, an adjacent landowner to the Lyster
Pit. The Landowner requested the Division look at the western portion of his field that shares the boundary
with the Lyster Pit. Mr. Ocker was concerned about the saturated and flooded soil on the western portion of
his field. This field has also become infested with Arrow Grass.
Hydrologic Balance:
During the inspection of the site, the pond located in the middle of the mine site was inspected. The portion
of the pond in the Phase II mining area is approved to remain as a permanent feature in conjunction with the,
yet to be reclaimed, portion of the pond in the Phase I mining area to support the post mining land use. The
pond was holding water during the inspection Photo 1). On the ground observations showed that the level of
the water in the pond was not at full capacity, as evidenced by water marks further up the banks of the pond.
The pond was stable and there were no indications of erosional features on the banks. The banks of the pond
were stable with vegetation.
There are two sediment retention ponds located at the northwest section of the Phase I area of the permit.
The embankments of the ponds were stable and vegetated. There were no indications of erosion. The ponds
Page 2 of 9
