Ll <br />October 14, 2020 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />Jason Burkey <br />Oldcastle SW Group, Inc. dba United Companies <br />2273 River Road <br />Grand Junction, CO 81505 <br />Re: Reason to Believe a Violation Exists and Notice of Board Hearing <br />Lyster Pit, Permit M-2008-009 <br />Mr. Burkey: <br />On September 17, 2020, the Division of Reclamation, Mining and Safety (Division) conducted an <br />inspection of the Lyster Pit (Permit M-2008-009) and found exposed, stagnant groundwater on the <br />northeast portion of the permit area. The exposed groundwater had also inundated the northwest portion <br />of the adjacent landowner's field, east of the permitted mine boundary. Based on the findings of the <br />inspection we believe this is a violation of: <br />• C.R.S. 34-32.5-116(4)(h) for failure minimize disturbances to the prevailing hydrologic balance <br />of the affected land and of the surrounding area and to the quality and quantity of water in surface <br />and groundwater systems both during and after the mining operation and during reclamation. <br />• C.R.S. 34-32.5-116(4)(i) for failure to protect areas outside of the affected land from slides or <br />damages occurring during the mining operation and reclamation. <br />Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act <br />for the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et sM., and have scheduled this matter <br />to appear before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the November 18-19, 2020 Board meeting for consideration <br />of the possible violation and corrective actions. Due to the impacts of the COVID-19 virus on the <br />availability of State facilities an&Division resources, notice is hereby given that the November 18-19, <br />2020 Board hearing will be held by a virtual ZOOM hearing. All exhibits and materials you wish for the <br />Board to consider related to this alleged violation must be submitted via email to the Board administrator, <br />Camille Mojar at Camille.Moiarcwstate.com no later than 5:00 p.m. on November 6 2020.
