BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Notice of Violation No. MV-2020-021 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF POSSIBLE VIOLATIONS BY MINERAL MOUNTAIN GOLD, <br />LLC, CEASE AND DESIST ORDER, CORRECTIVE ACTIONS, AND CIVIL <br />PENALTIES FOR FAILURE TO COMPLY WITH THE CONDITIONS OF PERMIT <br />M-2014-045 <br />THIS MATTER came before the Mined Land Reclamation Board C"Board") on <br />August 19, 2020 via video conference to consider possible violations by Mineral <br />Mountain Gold, LLC ("Operator"), cease and desist order, corrective actions, and civil <br />penalties for failure to comply with the conditions of permit M-2014-045. Lance <br />Barker appeared on behalf of the Operator. Elliott Russell and Senior Assistant <br />Attorney General Scott Schultz appeared on behalf of the Division of Reclamation, <br />Mining and Safety ("Division"). <br />The Board, having considered the parties' presentations, the materials <br />presented, and being otherwise fully informed of the facts in the matter, enters <br />the following: <br />FINDINGS OF FACT <br />L Operator holds a 110(d) limited impact permit for a 9.21-acre gold <br />mining operation located in Section 12, Township 15 South, Range 70 West, 6th <br />Principal Meridian in Teller County, Colorado, permit number M-2014-045. The <br />mine is known as the Mineral Mountain Project and is located approximately one <br />mile north of Cripple Creek, Colorado. <br />2. On June 2, 2020, the Division conducted a routine inspection of the <br />site. During the inspection, the Division noted that the Operator was using a <br />gravity and floatation mill, using xanthate in the flotation circuit for the mill, and <br />disposing of mill tailings in an unlined repository, none of which are allowed by the <br />permit. <br />3. The Division issued Operator a Reason to Believe a Violation Exists <br />letter on July 1, 2020 informing Operator that it viewed the unauthorized mill, use <br />of xanthate, and disposal of mill tailings in an unlined waste rock dump as <br />
